Former President Trump Requests Top Court Approval for National Guard Forces in the State of Illinois

Legal Battle Over Guard Activation
In an emergency filing, the justice department asked the bench to overturn a earlier court order that had blocked the deployment of several hundred military reserve members to the Chicago area.
The district judge had voiced concerns about the government's reasoning for activating the guard, questioning its explanation in light of regional circumstances.
A higher court affirmed the initial ruling on midweek, keeping the stationing on standby while the legal challenge proceeds.
Administration's Justifications
The top government lawyer, speaking on behalf of the administration, claimed in the recent request that federal agents have frequently been “intimidated and targeted” in downtown Chicago and the suburb of Broadview community.

The commander-in-chief has already sent state guard forces to the Windy City and Portland, following previous sendings to Los Angeles, California, Memphis, and Washington DC.

At the core of the dispute is the president’s use of a national law authorizing the executive branch to nationalize the national guard only in situations of rebellion or when “unable with the federal troops to enforce the statutes of the nation”.
The White House argues that the personnel are essential to safeguard government buildings and officers from activists.
